Fundamentweb is a service of Maarten de Klerk (“Fundamentweb” or “we”). Our address, Dutch Chamber of Commerce (KVK) number and contact address are at the top of this page.
By “you” we mean the business that buys a website through Fundamentweb.
When these terms apply
These terms apply to every website ordered through Fundamentweb and to the use of the dashboard. By paying, you accept them.
Fundamentweb is for businesses. You order as a business, for your business, not as a consumer.
Your own terms and conditions do not apply unless we agree to that in writing.
The service
You get a complete website for your business, built on a Fundamentweb template, with sample text in the language you chose when ordering.
The price includes: the website with all its pages, hosting with no monthly fees, the dashboard to change everything yourself, a free web address from Fundamentweb until you connect your own domain name, and a secure connection (https).
You edit the website yourself in the dashboard. Custom work, writing text or a custom design are not part of the service unless we agree on them separately.
Price and payment
A website costs a one-time €495 including VAT in the European Union, or $599 outside the European Union, without Dutch VAT. The price on the payment page applies.
You pay in advance through Stripe. You receive the invoice by email.
There is no subscription and there are no monthly fees. Only a domain name you buy through Fundamentweb costs a yearly renewal from the second year on (see “Domain names”).
Your website is created right after payment. That is why we do not refund the price, except if we cannot deliver the website: then you get the full amount back.
Your website
Within minutes of payment your website is ready, with sample text and sample photos. You get an email to log in to the dashboard.
Your website stays private until you click Publish in the dashboard. You can also take it offline again.
If you bought a sample website we made for your business in advance, that website becomes yours after payment, with the details that were on it.
Your content
You are responsible for everything on your website: text, photos, logos, prices, reviews and certifications. Make sure it is accurate and that you have the rights to it.
The sample text is a starting point. Check it and adapt it to your business before you publish. It contains no made-up reviews, projects or figures; add only real ones.
Content that is unlawful, misleading or infringes the rights of others is not allowed. We may then take that content or your website offline: after notifying you, or immediately if it is urgent.
The template, the design and the software remain Fundamentweb’s. You may use them for your website as long as it is hosted with us. Your own text, photos and logo remain yours.
Domain names
You can connect a domain name you already own to your website. It stays with your own provider, and you pay its costs there.
If you buy a domain name through the dashboard, the first year is included in the price. After that you renew it every year in the dashboard, at the price our registrar charges us, converted to euros. We send you reminders 30, 14, 7 and 1 day before the expiration date. If you do not renew in time, the domain name expires on the expiration date; your website then stays available at the free web address.
A domain name you bought through Fundamentweb is yours. On request you get the transfer code free of charge, so you can move it to another provider.
Availability and maintenance
We do our best to keep your website available at all times, but we cannot guarantee it. Fundamentweb runs on specialized providers, including Vercel and Supabase; outages on their side or maintenance can make your website temporarily unavailable.
We may improve and change the template and the dashboard. Your own text, photos and settings stay as they are.
Your visitors’ data
Visitors to your website can send information through the forms, such as an estimate request. You are responsible for that information (controller). Fundamentweb only processes it on your behalf (processor): to send it to your email address. This section is our data processing agreement.
We use that information only to provide the service, keep it confidential and protect it appropriately. For this we use only these subprocessors: Vercel (hosting), Supabase (database) and Resend (email). We will tell you in advance about any new subprocessor.
We help you when a visitor exercises their rights, and we report a data breach to you without undue delay. After the service ends, we delete the information.
How Fundamentweb handles your own data is described in our privacy statement.
Canceling
You can cancel at any time: send us an email. Your website then stays online for 3 more months, so you can switch at your own pace. We email you the date, and a reminder one week before.
On that date your website goes offline and we disconnect your domain name, so you can use it elsewhere. After that we delete your website’s data. If you want to keep your text and photos, ask us for them before that date.
We may end the service if you seriously breach these terms, for example with unlawful content. If Fundamentweb shuts down entirely, you will hear about it at least 3 months in advance.
Liability
Fundamentweb is only liable for direct damage caused by a failure attributable to us, and up to no more than the amount you paid for your website.
We are not liable for indirect damage, such as lost revenue or customers, or for damage caused by a temporary outage.
These limits do not apply in case of intent or willful recklessness on Fundamentweb’s part.
You indemnify Fundamentweb against claims by others about the content you put on your website.
Changes
We may change these terms. We will notify you of a change by email at least 30 days in advance. If you do not agree, you can cancel as described under “Canceling”.
A change never increases the price you already paid.
Governing law and disputes
These terms and every agreement with Fundamentweb are governed by the laws of the Netherlands.
If you have a complaint, please email us first: we are happy to work out a solution together. If we cannot agree, the competent court of the District Court of Limburg (Netherlands) decides, unless the law requires otherwise.
These terms exist in Dutch, English, German and Spanish. In case of any difference, the Dutch text prevails.
